Welcome to Captured by Marigold. By booking our services or using our website, you agree to the following terms and conditions. Please read them carefully before proceeding.

1. Booking & Payment

  • A non-refundable 25% deposit is required at the time of booking to secure your event date.

  • The remaining balance is due no later than 14 days prior to the event. Failure to pay by this deadline may result in cancellation and forfeiture of your deposit.

  • Bookings made within 14 days of the event require full payment at the time of booking.

  • Your booking is only confirmed once both the deposit and written confirmation are received.

  • Payment options will be provided at the time of booking.

2. Cancellations & Rescheduling

  • Deposits are non-refundable under all circumstances.

  • Clients may request to reschedule at least 30 days prior to the event date with no rescheduling fee. We will do our best to accommodate the new date, subject to availability.

  • Rescheduling requests made within 30 days from the event may incur in a 10% rescheduling fee of your finalized package.

  • If you cancel with at least 30 days’ prior to the event, the deposit will be forfeited.

  • If you cancel within 30 days from the event, it will result in a 30% cancelation fee.

  • For outdoor events, clients are responsible for securing a weather-appropriate indoor backup. We will not operate outdoors in conditions that risk damage or safety, such as rain, high winds, excessive heat, or cold.

3. Service & Equipment

  • We provide a full-service photo booth setup, including a professional DSLR camera, backdrop, props (if applicable), on-site attendant, and instant prints or digital delivery.

  • We will need to set up 60-90 minutes before the photo booth start time to ensure everything is working.

  • A 10' x 10' level space and electrical outlet within 15 feet are required for setup.

  • We are not responsible for disruptions caused by venue limitations, power issues, or environmental conditions.

4. Photo Use & Consent

  • By using the booth, guests consent to being photographed and having their images stored digitally.

  • We may use select photos for marketing purposes from the client or guests.

  • Clients may request that specific images be removed or withheld from public use at any time.

5. Client Responsibilities

  • Clients are responsible for guest behavior during booth operation.

  • We reserve the right to pause or terminate services without refund if equipment is at risk due to inappropriate behavior.

  • Clients are liable for repair or replacement costs if equipment is damaged due to negligence.

6. Digital Galleries & Delivery

  • Digital photo galleries are delivered within 3 business days after the event.

  • Instant prints (if included) are provided on-site. Additional reprints may be requested for a fee.

7. Website Use

By accessing or using our website, you agree not to:

  • Copy or reproduce content without permission

  • Use the site for unlawful or harmful purposes

  • Attempt to breach or interfere with our systems

8. Limitation of Liability

  • We are not responsible for delays, service interruptions, or photo loss due to force majeure (e.g., natural disasters, power outages).

  • Our total liability is limited to the amount paid for our services.

9. Intellectual Property

All content, branding, and imagery on this website is the property of Captured by Marigold and may not be copied or distributed without written permission.

10. Changes to Terms

We reserve the right to update these Terms & Conditions at any time. Any changes will be posted on this page with a new effective date.
